These Terms of Use ("Terms") govern your access to and use of Togo Goo, including the website at tggoo.tg and the marketplace services, features, content, and functionality made available through the platform.

By accessing or using Togo Goo, creating an account, posting a listing, or otherwise using the platform, you agree to these Terms and to the policies that apply to your use of Togo Goo. If you do not agree, you should not use the platform.

1. Acceptance of Terms

You are responsible for reviewing these Terms before using Togo Goo. Your continued use of the platform constitutes acceptance of the Terms then in effect, subject to applicable law.

2. About Togo Goo

Togo Goo is an online marketplace designed to help individuals and businesses connect locally to advertise, discover, buy, sell, and promote goods and services.

Unless expressly stated otherwise, Togo Goo provides the technology and marketplace through which users can connect. Togo Goo is not ordinarily the buyer, seller, owner, manufacturer, supplier, employer, agent, broker, or service provider in transactions arranged between independent users.

3. Eligibility and Accounts

You may use Togo Goo only if you are legally permitted to enter into the transactions and activities you undertake through the platform. If you use Togo Goo on behalf of a business or other organization, you represent that you have authority to act on its behalf.

When an account is required, you must provide accurate and current information and keep your account information up to date. You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account, subject to applicable law.

You must promptly notify Togo Goo if you believe your account has been accessed or used without authorization.

4. Marketplace Role

Togo Goo provides a marketplace where users can publish listings and communicate with one another. Unless Togo Goo expressly identifies itself as a party to a particular transaction, agreements for the purchase, sale, rental, employment, or provision of goods or services are made directly between the users involved.

Users are responsible for evaluating listings, counterparties, products, services, prices, descriptions, ownership, condition, legality, and other information relevant to a transaction before proceeding.

5. Listings and User Content

You are responsible for listings, messages, images, descriptions, reviews, feedback, and other content you submit to Togo Goo ("User Content").

You must have the rights, permissions, and authority necessary to submit your User Content. User Content must be accurate and must not be unlawful, fraudulent, misleading, infringing, abusive, or otherwise prohibited by these Terms or Togo Goo policies.

You retain ownership of rights you hold in your User Content. By submitting User Content to Togo Goo, you grant Togo Goo a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, and distribute that content as reasonably necessary to operate, secure, promote, and improve the platform and the relevant listing or service.

6. Listing Policy and Other Platform Policies

Listings posted on Togo Goo must comply with the Listing Policy. Depending on how you use the platform, additional policies may apply, including the Billing Policy, Cookie Policy, Privacy Policy, and Safety Tips.

These policies form part of the rules governing the relevant features or services of Togo Goo. If a specific policy applies to a particular feature or transaction, you are responsible for complying with it.

7. Buying, Selling and User Transactions

Users are responsible for communicating clearly, reviewing relevant information, and exercising appropriate care before completing a transaction.

Unless Togo Goo expressly provides a transaction service and states otherwise, Togo Goo does not guarantee a user's identity, the existence or condition of an item, the quality of a service, a user's authority to sell or provide something, or whether a transaction will be completed.

Users are responsible for complying with laws and obligations applicable to their own transactions, including requirements relating to ownership, licensing, taxes, permits, consumer protection, employment, and regulated goods or services where applicable.

8. Prohibited Conduct

You must not use Togo Goo to:

• engage in fraud, deception, theft, or other unlawful activity;
• post prohibited, illegal, counterfeit, stolen, or unauthorized items or services;
• impersonate another person or misrepresent your identity, affiliation, authority, or intentions;
• harass, threaten, exploit, discriminate against, or unlawfully harm another person;
• infringe intellectual property, privacy, publicity, or other rights;
• send spam, manipulate listings, create deceptive duplicates, or interfere with marketplace integrity;
• introduce malware or attempt unauthorized access to accounts, systems, data, or infrastructure;
• scrape, harvest, copy, or use platform data through unauthorized automated means;
• circumvent security, moderation, access restrictions, payment requirements, or other platform controls; or
• use Togo Goo in a manner that violates these Terms, an applicable Togo Goo policy, or applicable law.

9. Fees, Payments, Credits and Promotions

Some Togo Goo features may be free while others may require payment or the use of credits. Available services, prices, payment methods, credit values, promotional benefits, referral rewards, validity periods, and other conditions may be displayed on the platform at the relevant time.

Paid services, credits, promotions, refunds, and related billing matters are also governed by the Billing Policy.

You are responsible for reviewing the applicable price and conditions before authorizing a payment or using a paid feature.

10. Intellectual Property

Togo Goo and its licensors retain their rights in the platform, including its software, branding, logos, designs, interfaces, and other protected materials, except for User Content owned by users or materials belonging to third parties.

You may use Togo Goo only for lawful purposes consistent with these Terms. Nothing in these Terms transfers ownership of Togo Goo intellectual property to you.

11. Copyright and Intellectual Property Complaints

Togo Goo respects intellectual property rights. If you believe content on the platform infringes rights that you own or are authorized to enforce, you may submit a complaint to support@tggoo.tg.

Your notice should provide sufficient information for Togo Goo to review the complaint, including:

• your name and contact information;
• identification of the protected work, mark, or other right concerned;
• identification or location of the allegedly infringing content;
• an explanation of the basis for your complaint;
• a statement describing your ownership or authority to act for the rights holder; and
• any supporting information reasonably necessary to evaluate the request.

Togo Goo may remove or restrict content, request additional information, or take other appropriate action after reviewing a complaint. Users must not knowingly submit false or misleading intellectual property complaints.

12. Third-Party Services and Links

Togo Goo may contain links to, integrations with, advertisements for, or services provided by third parties. Third-party services are governed by their own terms, policies, practices, and availability.

A link or integration does not by itself mean that Togo Goo controls or endorses the third party. You should review the relevant third-party terms and policies before using those services.

13. Privacy and Cookies

Information about Togo Goo's handling of personal information and use of cookies or similar technologies is provided through the applicable privacy and cookie notices available on the platform, including the Privacy Policy and Cookie Policy.

14. Suspension and Termination

Togo Goo may review, reject, restrict, remove, or moderate listings and other content and may restrict, suspend, or terminate access to accounts or features when reasonably necessary to enforce these Terms or platform policies, protect users or the platform, respond to legal requirements, investigate suspected misuse, or address security or operational risks.

Where appropriate and reasonably practicable, Togo Goo may provide notice or an opportunity to address an issue. Certain circumstances may require immediate action.

15. Availability and Changes to the Service

Togo Goo may add, modify, suspend, or discontinue features or services. The platform may occasionally be unavailable because of maintenance, security events, technical problems, third-party service interruptions, or circumstances outside Togo Goo's reasonable control.

Togo Goo does not guarantee that every feature will always be available, uninterrupted, error-free, or suitable for every user's particular needs.

16. Disclaimers

To the extent permitted by applicable law, Togo Goo is provided on an "as is" and "as available" basis. Togo Goo does not guarantee the accuracy, quality, legality, safety, availability, ownership, condition, or performance of listings, User Content, users, goods, services, employment opportunities, properties, vehicles, or transactions provided or arranged by independent users.

Nothing in these Terms excludes warranties, rights, or protections that cannot lawfully be excluded or restricted.

17. Limitation of Liability

To the maximum extent permitted by applicable law, Togo Goo and persons acting on its behalf will not be liable for indirect, incidental, special, consequential, exemplary, or similar losses arising from or connected with use of the platform where such liability may lawfully be limited or excluded.

Togo Goo does not exclude or limit liability where doing so would be prohibited by applicable law. Any rights or remedies that cannot lawfully be waived or restricted remain unaffected.

18. Indemnification

To the extent permitted by applicable law, you are responsible for losses, claims, or expenses resulting from your unlawful use of Togo Goo, your material violation of these Terms or applicable platform policies, your User Content, or your infringement of another person's rights.

This section applies only to the extent that such responsibility may lawfully be imposed under applicable law.

19. Disputes and Applicable Law

If you have a concern or dispute involving Togo Goo, please first contact support@tggoo.tg and provide enough information for the matter to be reviewed. Togo Goo and the user may attempt to resolve the matter informally where appropriate.

Any unresolved dispute will be handled in accordance with applicable law and before a court or other competent authority having jurisdiction over the matter. Nothing in these Terms removes rights, remedies, or protections that cannot lawfully be waived.

20. Changes to These Terms

Togo Goo may update these Terms to reflect changes to the platform, business practices, policies, security requirements, or legal and regulatory obligations.

The updated Terms will be made available on the platform with an updated revision date. Where additional notice is required by applicable law or is appropriate because of a material change, Togo Goo may provide additional notice through the platform or another appropriate communication method.

Your continued use of Togo Goo after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.

21. Severability

If a provision of these Terms is determined by a competent authority to be invalid, unlawful, or unenforceable, that provision will be treated as modified or severed to the extent necessary, while the remaining provisions will continue to apply to the extent permitted by law.

22. Entire Agreement

These Terms, together with the Togo Goo policies and additional terms that expressly apply to a particular service or feature, constitute the agreement governing your use of those services and features.
